TERMS OF SERVICE

Welcome to Triwaz. These Terms of Service ("Terms") govern your access to and use of the Triwaz website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. NATURE OF THE SERVICE

Triwaz provides access to an artificial intelligence aggregation platform designed for AI collaboration and analysis. The platform does not endorse any specific stance or viewpoint; the choice of stance and the interpretation of results are solely the user's explicit action and responsibility.

To improve platform performance and reduce redundant API costs, Triwaz employs semantic caching technology. De-identified debate topics and their associated outputs may be stored and reused when a sufficiently similar query is submitted by any user. Cached results are anonymized and are not associated with any individual account.

2. AGE REQUIREMENTS AND DISCLAIMER

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you must have your parent or legal guardian's permission. We do not independently verify user age. To the extent permitted by law, Triwaz disclaims liability for any use of the Service by minors without valid parental consent. If you are a parent or guardian who becomes aware of such use, please contact us immediately.

3. AI-GENERATED CONTENT & DISCLAIMERS

  • No Guarantee of Accuracy or Fitness: AI models can make mistakes or produce hallucinations. We do not warrant that the Service is fit for any particular purpose. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
  • No Professional Advice: The platform does not provide legal, medical, financial, or any other professional advice. You must not rely on the platform's outputs for critical decision-making.
  • Anti-Reliance & User Responsibility: Users assume full responsibility for the verification of outputs prior to any reliance. You are solely responsible for evaluating outputs, implementing appropriate human review, and determining whether any output is appropriate for your use case. You agree not to use outputs as a definitive statement of fact in any formal or legally significant context. You are solely responsible for how you interpret, share, and utilize the generated conclusions. The arguments generated by the AI do not reflect the opinions, beliefs, or endorsements of Triwaz, its creators, or its affiliates.
  • Model Availability: We may swap or upgrade underlying third-party models at our discretion.
  • No Misrepresentation: You may not represent that output from the Service was human-generated when it is not.
  • Third-Party Dependency: We are not liable for failures caused by third-party providers (e.g., OpenAI, xAI, Google, Groq, Serper).

4. MODEL ROUTING & RESERVE MODEL

The Service routes requests to the AI models associated with the user's selected tier. If a selected model is unavailable or fails to respond, the Service may automatically use a reserve model to complete the request. The current reserve model is Meta LLaMA 3.3-70B (served via Groq).

Responses generated by a reserve model are identified with an asterisk (*) next to the model name. Available models and routing configurations may change at any time.

5. VIRTUAL CREDITS (TRI) AND BILLING

All debate executions consume a proprietary virtual credit called "TRI".

  • Not a Financial Instrument: TRI does not constitute electronic money, stored value, or any form of financial instrument.
  • Purchasing TRI & Merchant of Record: All financial transactions are handled by our Merchant of Record, Creem. Your billing statement will appear as 'Creem'. For billing inquiries or disputes, please contact us at hello@triwaz.com.
  • No Cash Value: TRI credits hold no cash value, cannot be exchanged for fiat currency, and are non-transferable.
  • Expiry: Unused TRI expires 365 days after the date of purchase. Expired TRI is forfeited without compensation.
  • Pricing Changes: We may update TRI purchase prices or the TRI consumption rate of any tier at our discretion. We will endeavor to provide reasonable notice of material changes. Existing TRI balances will not be affected by pricing changes.

6. TRI DEDUCTIONS AND REFUND POLICY

  • Finality of Deductions: All TRI deductions are final once a debate is initiated. Token consumption is driven by third-party LLM APIs — GPT, Gemini, and Grok — which charge per request regardless of output quality or completion. We have no mechanism to recover those costs.
  • 24-Hour Refund Window: Refunds for unused TRI may be requested within 24 hours of purchase. If no request is received within 24 hours, or if any TRI has been consumed, the purchase becomes non-refundable. To request a refund, contact hello@triwaz.com.
  • Statutory Rights: Nothing in this section limits any mandatory refund rights you may have under applicable consumer protection law in your jurisdiction.

7. INTELLECTUAL PROPERTY AND SHARING

  • Ownership: You retain ownership of your input. Triwaz assigns to you such rights in the output as it has received from model providers. We do not warrant that the output is free of third-party intellectual property claims.
  • Assumption of Risk in Sharing: Any conclusion displayed on a generated "Share Card" or similar output is solely an AI collaborative analysis result, not a statement of fact or the platform's viewpoint. Triwaz bears no responsibility for any legal disputes, reputational damage, or legal prosecution (e.g., defamation claims) arising from your act of sharing content. You share content entirely at your own risk and assume all associated legal consequences.

8. ACCEPTABLE USE POLICY

You agree not to generate illegal content, hate speech, or explicit violence; attempt to exploit TRI mechanisms; or engage in unauthorized automated scraping.

9. ACCOUNT TERMINATION AND TRI FORFEITURE

We reserve the right to suspend or terminate accounts and forfeit TRI balances for violations.

  • Serious Violations: In cases of fraud, API abuse, or severe policy violations, we may immediately suspend accounts and forfeit TRI reasonably connected to the violation.
  • Notice and Remedy: In cases not involving illegal activity or government orders, we will provide reasonable prior notice and, where the violation is curable, a reasonable opportunity to remedy before terminating access.
  • Platform-Initiated Termination: If we terminate your account for reasons other than a violation of these Terms, any unused TRI will be refunded to your original payment method within 30 days of termination.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Triwaz, its creators, and its operators from and against any claims, liabilities, damages, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

11. LIMITATION OF LIABILITY

TRIWAZ IS AN EXPERIMENTAL LOGIC AND DEBATE SIMULATION ENGINE. IT PROVIDES AN AI COLLABORATIVE ANALYSIS TOOL, NOT AN ENCYCLOPEDIA OF FACTS. UNDER NO CIRCUMSTANCES SHALL TRIWAZ, ITS CREATORS, OR ITS AFFILIATES BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOSSES, REPUTATIONAL DAMAGE, OR ANY FORM OF LEGAL PROSECUTION ARISING FROM YOUR USE, INTERPRETATION, OR DISSEMINATION OF THE GENERATED OUTPUTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF TRIWAZ SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO TRIWAZ IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM; OR (B) USD 50.

12. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of Taiwan (R.O.C.). Any legal action shall be brought exclusively in the Taipei District Court in Taiwan. Notwithstanding the foregoing, Triwaz reserves the right to seek injunctive relief in any jurisdiction. This provision shall not deprive you of any mandatory consumer protections under the laws of your jurisdiction.

13. MISCELLANEOUS

  • Entire Agreement: These Terms and our Privacy Policy supersede any prior agreements or communications.
  • Modifications: Material revisions will be notified at least 30 days before taking effect.
  • Notices: All legal notices to Triwaz must be sent to: hello@triwaz.com (Taipei, Taiwan, R.O.C.).
  • Severability: If any provision is held unenforceable, the remainder remains in effect.
  • Force Majeure: We are not liable for failures caused by events beyond our control (e.g., natural disasters, war, infrastructure failures).
  • Survival: Provisions regarding disclaimers, intellectual property, indemnification, limitation of liability, and any other provisions that by their nature should survive, shall continue in effect after termination of your account or cessation of the Service.
