TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the TRIWAZ website, Android application, and related services, software, features, content, and functionality (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

1. WHO MAY USE THE SERVICE

You must be at least 13 years old, or the minimum age required in your jurisdiction to use the Service. If you are under 18, you must have permission from a parent or legal guardian. If you use the Service on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.

You are responsible for providing accurate account information, maintaining the security of your account and authentication methods, and all activity that occurs through your account. You may not sell, transfer, share, or make your account available to another person.

2. NATURE OF THE SERVICE

TRIWAZ is an artificial intelligence aggregation, debate, and analysis platform. It structures a submitted topic, routes requests through multiple artificial intelligence systems, and presents model-generated arguments and conclusions. TRIWAZ is not a chatbot, search engine, encyclopedia, fact-checking authority, or professional adviser, and it does not endorse any political, ideological, commercial, or personal position.

To improve speed, reliability, consistency, availability, and resource efficiency, TRIWAZ may use caching, retrieval, similarity matching, retry logic, reserve models, and other automated optimization or continuity techniques.

3. MODELS, ROUTING, AND THIRD-PARTY SERVICES

The primary models currently associated with each tier are:

Model names, developers, providers, routing configurations, availability, performance, features, and technical requirements may change. TRIWAZ may add, replace, upgrade, downgrade, suspend, or remove a model or provider where we consider it reasonably appropriate for availability, quality, performance, safety, security, legal compliance, cost management, or service continuity.

If a primary model is unavailable, delayed, restricted, returns an unusable response, or otherwise cannot complete a request, TRIWAZ may use a reserve model, alternative provider, cached result, retry strategy, or other continuity mechanism. A reserve response may be identified with an asterisk (*) or another indicator where displayed by the Service. Use of an alternative mechanism does not by itself entitle you to a refund or TRI restoration.

The Service relies on third-party artificial intelligence, model-hosting, search, transcription, payment, advertising, authentication, database, security, and infrastructure services. Third-party services and third-party content are subject to their own terms, policies, restrictions, availability, and service configurations. To the maximum extent permitted by applicable law, TRIWAZ does not control and is not responsible for independent third-party acts, omissions, outages, policy changes, data practices, or service modifications.

4. INPUTS, OUTPUTS, AND INTELLECTUAL PROPERTY

You are responsible for all text, topics, instructions, files, audio, and other materials you submit to the Service ("Inputs"). You represent and warrant that you have all rights, licenses, permissions, and lawful authority necessary for TRIWAZ and its providers to process your Inputs and provide the Service.

As between you and TRIWAZ, and to the extent permitted by applicable law and applicable third-party terms, you retain any rights you have in your Inputs. Subject to your compliance with these Terms, TRIWAZ assigns to you any right, title, or interest that TRIWAZ may have in outputs generated specifically for you ("Outputs").

This assignment does not apply to the Service, software, models, prompts, templates, interfaces, system instructions, branding, documentation, third-party content, cached materials, or Outputs generated for other users. Outputs may not be unique, and other users may receive identical or similar content. TRIWAZ does not represent or warrant that any Output is copyrightable, protectable, unique, non-infringing, or free from third-party rights.

You grant TRIWAZ a worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit, adapt, and otherwise use Inputs and Outputs as reasonably necessary to provide, maintain, secure, enforce, troubleshoot, and improve the Service; comply with law; prevent fraud and abuse; and exercise or defend legal rights.

Feedback, suggestions, ratings, and ideas you provide may be used by TRIWAZ without restriction or compensation to you.

5. AI-GENERATED CONTENT AND USER RESPONSIBILITY

Outputs may be inaccurate, incomplete, outdated, biased, offensive, misleading, or inconsistent, even when they appear detailed or confident.
You must independently review and verify Outputs before relying on, publishing, sharing, or acting on them.
The Service does not provide legal, medical, financial, tax, investment, employment, educational, insurance, or other professional advice.
You are solely responsible for how you interpret, use, disclose, distribute, or rely on Inputs and Outputs.
Outputs do not represent the opinions, beliefs, endorsements, or factual statements of TRIWAZ, its operators, affiliates, or providers.
You may not falsely represent AI-generated Output as human-generated where that representation would be deceptive, unlawful, or materially misleading.

6. TRI, PURCHASES, AND SUBSCRIPTIONS

Certain features consume TRIWAZ virtual credits called "TRI." TRI is a limited, revocable, non-transferable license to access eligible features within the Service. TRI is not money, electronic money, stored value, property, a security, a financial instrument, or a claim against TRIWAZ. TRI has no cash value and cannot be exchanged, transferred, resold, or redeemed for fiat currency.

Guest accounts. Guest accounts are temporary and are automatically and permanently deleted approximately 30 days after creation, together with associated data and remaining TRI. A guest account must be linked to a permanent email or third-party sign-in method before making a purchase or starting a paid subscription.
Web payments. Purchases made on the TRIWAZ website are processed through Creem, our Merchant of Record.
Android payments. Purchases and subscriptions made through the TRIWAZ Android application are billed and administered by Google Play and are also subject to Google Play terms and policies.
TRIWAZ VIP. The current TRIWAZ VIP plan is a USD $20 monthly auto-renewing subscription. Each billing period currently includes TRI 200K and 30% off eligible debate costs. Discounts, promotional rates, reduced-price continuation features, and VIP benefits do not stack unless TRIWAZ expressly states otherwise.
Cancellation. Web subscriptions may be canceled through REFILL. Android subscriptions must be managed through Google Play. Cancellation stops future renewals. Unless an applicable platform or law requires otherwise, benefits continue until the end of the current paid billing period and TRI already credited remains in the account.
No expiry during normal operation. TRI held in a permanent account does not expire during the normal operation of the Service, but remains subject to these Terms, account termination, refunds, reversals, chargebacks, service discontinuation, and applicable law.

7. TRI DEDUCTIONS, REFUNDS, AND REVERSALS

TRI deductions become final once processing of a debate or related feature has begun. TRI is charged for initiating and providing the Service and is not contingent on the accuracy, completeness, usefulness, uniqueness, availability, or subjective quality of an Output.

A partial, delayed, interrupted, reserve-model, cached, retried, or otherwise modified result does not automatically entitle you to a refund or TRI restoration. Dissatisfaction with an Output, disagreement with a conclusion, model variation, similarity to another Output, or failure to achieve a particular result does not by itself qualify for a refund.

Website purchases. You may request a refund for unused TRI within 24 hours after a website purchase by contacting hello@triwaz.com and providing the purchase details. Once any TRI from that purchase has been used, the purchase is non-refundable, except where required by applicable law.
Google Play purchases.Refund eligibility, processing, timing, revocation, and subscription cancellation for Android purchases may be governed by Google Play policies and applicable law. You may use Google Play's available refund procedures or contact TRIWAZ for assistance.
Reversals and clawbacks. A refund, chargeback, payment reversal, revoked purchase, duplicate credit, fraud determination, or platform adjustment may result in the removal of associated TRI, discounts, subscription benefits, or other entitlements. If the account balance is insufficient, the balance may become negative or access may be restricted until the adjustment is resolved.
Mandatory rights. Nothing in these Terms limits refund, cancellation, or consumer rights that cannot lawfully be waived.

8. ACCEPTABLE USE

You may not use the Service to:

Violate applicable law or the rights of another person.
Generate, facilitate, distribute, or promote unlawful, fraudulent, abusive, hateful, exploitative, or explicitly violent content.
Harass, defame, impersonate, deceive, threaten, or invade another person's privacy or publicity rights.
Exploit, manipulate, reverse engineer, bypass, or interfere with TRI, advertising rewards, billing, authentication, rate limits, security controls, model restrictions, or Service operations.
Use automated means to scrape, extract, copy, benchmark, monitor, or access the Service without written permission.
Introduce malware, harmful code, denial-of-service activity, or unauthorized access attempts.
Use the Service or Outputs to make unlawful or high-impact decisions about another person without appropriate human review and lawful authority.

We may investigate suspected violations and may remove content, withhold rewards, reverse TRI, restrict features, or suspend or terminate accounts where reasonably necessary.

9. SHARING AND PUBLICATION

You are responsible for any Output, conclusion card, screenshot, link, or other material you publish or share. You must not present AI-generated analysis as verified fact, imply that TRIWAZ endorses your position, or use TRIWAZ branding in a way that suggests sponsorship, affiliation, or approval without written permission.

To the maximum extent permitted by law, TRIWAZ is not responsible for claims, proceedings, investigations, penalties, liabilities, losses, damages, or reputational harm arising from your publication, sharing, or other use of Inputs or Outputs.

10. SUSPENSION, TERMINATION, AND DISCONTINUATION

You may stop using the Service or delete your account at any time. Account deletion is permanent and removes the account, remaining TRI, and associated debate history, subject to records that may be retained as described in the Privacy Policy.

We may suspend, restrict, or terminate access, remove content, or disable features if we reasonably believe you violated these Terms or another applicable policy; created risk, harm, liability, fraud, or abuse; failed to pay amounts due; or if action is required for legal, regulatory, security, safety, or operational reasons.

TRI may be forfeited to the extent reasonably connected to fraud, abuse, unauthorized acquisition, chargebacks, refunds, duplicate credits, exploitation of reward mechanisms, or other violations, and where otherwise permitted by law.

Where reasonably possible, and except in urgent, illegal, fraudulent, security-sensitive, or legally restricted circumstances, we may provide notice and an opportunity to address a curable issue before terminating access.

If TRIWAZ permanently discontinues the Service or terminates a paid account for reasons unrelated to a violation, unused paid TRI will be handled in accordance with applicable law and our then-current refund policy. Promotional or complimentary TRI may be withdrawn to the extent permitted by law.

11. DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, MODELS, OUTPUTS, CONTENT, FEATURES, AND ALL RELATED MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TRIWAZ AND ITS PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, QUIET ENJOYMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR REQUIREMENTS.

TRIWAZ DOES NOT WARRANT THAT ANY OUTPUT IS TRUE, CURRENT, COMPLETE, UNIQUE, LAWFUL, SAFE, OR SUITABLE FOR ANY PARTICULAR USE. YOU ACCEPT THE RISKS INHERENT IN ARTIFICIAL INTELLIGENCE, AUTOMATED PROCESSING, THIRD-PARTY SERVICES, INTERNET TRANSMISSION, AND MODEL VARIATION.

12. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless TRIWAZ, its operators, affiliates, personnel, contractors, licensors, and providers from and against claims, proceedings, liabilities, damages, judgments, losses, penalties, costs, and expenses, including reasonable legal fees, arising out of or relating to your Inputs, Outputs, use or misuse of the Service, breach of these Terms, violation of law, infringement of another person's rights, fraud, willful misconduct, or dispute with a third party.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIWAZ, ITS OPERATORS, AFFILIATES, PERSONNEL, CONTRACTORS, LICENSORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, OR ANTICIPATED SAVINGS; REPUTATIONAL HARM; SERVICE INTERRUPTION; OR DAMAGES ARISING FROM THIRD-PARTY SERVICES, INPUTS, OUTPUTS, OR RELIANCE ON AI-GENERATED CONTENT, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF TRIWAZ AND THE OTHER PARTIES DESCRIBED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO TRIWAZ FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) USD 50.

Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law and do not limit rights or liabilities that cannot lawfully be limited.

14. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Taiwan (R.O.C.), without regard to conflict-of-law principles. Subject to any mandatory rights available in your jurisdiction, the Taipei District Court in Taiwan will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service. Nothing in these Terms prevents TRIWAZ from seeking injunctive or protective relief in another jurisdiction where reasonably necessary.

15. CHANGES AND MISCELLANEOUS

We may revise these Terms or modify the Service at our discretion, including to reflect changes to features, models, providers, routing, pricing, TRI amounts, consumption rates, subscriptions, discounts, benefits, rewards, business practices, security requirements, applicable law, or measures intended to promote safety or prevent fraud and abuse.

Updated Terms take effect when posted or on the stated effective date, unless applicable law or an applicable payment platform requires otherwise. Your continued access to or use of the Service after the updated Terms take effect constitutes your acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the Service before they take effect. Changes affecting an active subscription remain subject to applicable law and the requirements of the applicable payment platform.

Entire agreement. These Terms, the Privacy Policy, and any applicable supplemental terms form the entire agreement between you and TRIWAZ regarding the Service.
Supplemental terms. Additional terms or policies may apply to particular features. If supplemental terms conflict with these Terms, the supplemental terms control for that feature.
Assignment. You may not assign these Terms without our prior written consent. TRIWAZ may assign these Terms in connection with a reorganization, financing, merger, acquisition, sale of assets, or transfer of the Service.
No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
Severability. If a provision is invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain effective.
Force majeure. TRIWAZ is not liable for delay or failure caused by events beyond its reasonable control, including natural disasters, war, labor disputes, internet or infrastructure failures, provider outages, government action, or widespread security incidents.
Third-party beneficiaries.TRIWAZ's providers, licensors, and affiliates are intended third-party beneficiaries of provisions that disclaim warranties, limit liability, allocate responsibility, or protect their services and rights.
Survival. Provisions that by their nature should survive termination, including provisions regarding payment, intellectual property, disclaimers, indemnification, liability, disputes, and enforcement, will survive.
